This first step is to settle everybody into the Mediation and help you to understand what will be happening today. This will include details on My Role, some Housekeeping, Confidentiality statements, Your Role and Ground Rules for the session.
This is your opportunity to speak about the issues that you would like to deal with today. You will also hear the issues that the other party would like to discuss.
This is where we decide on the issues to be discussed (depending on what both parties had mentioned). We will keep referring back to the Agenda throughout the session.
We ensure that the Agenda holds the key issues to be raised and that you are both willing to try to settle these issues during the session.
This is the most important part of the whole Mediation Session. This is where you get to speak about the issues that you deem relevant and explain your point of view. Hoping that the other party can understand your viewpoint. You will also get to listen and speak to each other to try to settle the issues raised and start to negotiate a fair outcome for you both.
This is where both parties get approximately 10 minutes privately with me to discuss any concerns you may have in relation to the Session. Try to brainstorm some ideas to take back. This process is completely confidential so you would need to bring ideas back from our Session if you feel it worthy.
After the Private Sessions hopefully, you both have some worthy ideas to bring back to the joint session to try to negotiate.
Once you have negotiated and agreed to strategies to the issues raised today, I will write up the Agreement (in your words). This will then be forwarded to all parties, with a view to signing if appropriate.
Once the Agreement has been written, the Mediation session is then closed. Opportunity to follow up in 8-12 weeks is always offered in case the Agreement needs fine tuning or other issues arise.
